Algemene voorwaarden
General Terms and Conditions
1. Area of validity
The following Terms and Conditions apply to all contracts, deliveries and services between Tischlerschuppen - der Webshop für Holzbauklötze der besonderen Art (the web shop for special wooden building blocks), Proprietor Michael Wirges, Auf der Höh 32, 53819 Neunkirchen-Seelscheid, Germany, with its domain www.tischlerschuppen.de and all other registered domains for the distribution purposes of wooden building blocks and its customers.
2. Prices and changes
1. The respective price stated for our goods is the final price including any Value Added Tax if applicable and including further price components. The price does not include the costs for delivery and forwarding.
2. With the update of the Internet sites of www.tischlerschuppen.de all previous prices and other details about goods are invalid.
3. The price at the time of the customer’s submission of the offer is significant for the invoice.
3. Offer and conclusion of the contract
1. The contractual language is German. The presentation of the products in the online shop does not represent a legally binding offer, but an unbinding online catalogue.
2. After the entry of your personal details and by clicking the button “BESTELLEN” (PLACE ORDER) in the final step of the order process you submit a binding order of the goods placed in the shopping basket. The receipt of the order is confirmed immediately after the submission of the order. However, the contract of purchase is concluded only with our confirmation of the order or the delivery of the goods.
4. Viewing the text of the contract
The text of the contract is saved. You may view General Contractual Conditions at any time at Tischlerschuppen.de and save the same on your computer. The actual order details as well as the General Contractual Conditions will be sent to you via email and may be viewed upon the registration in the login area.
5. Delivery
The delivery is plus costs for forwarding. If an item is out of stock due to an unexpected high demand, the buyer may withdraw from the contract. The delivery is subject to the delivery costs stated. If the goods are not available without our fault, the consumer will be notified about that immediately and any counter performances, which might possibly have been provided already, will be returned.
6. Costs for returns
If the consumer makes use of his right of rescission according to Clause 7 of the General Terms and Conditions, he must bear the costs for the returns, if the delivered goods correspond to the ordered goods and if the price of the goods to be returned does not exceed the amount of 40.00 Euros or if in the case of a higher price of the goods the return service or the contractually agreed partial payment has not been fulfilled at the point of the rescission.

7. Cancellation policy/Right of rescission
You may revoke your contractual declaration within two weeks without providing reasons in written form (e.g. fax, email) or – if you are handed over the object before the expiry of the term – by returning the good. The term commences with the receipt of this instruction in written form, however, not before the receipt of the goods (for recurrent deliveries of similar goods not before the receipt of the first partial delivery) and not before the fulfilment of our obligation to information according to § 312c Para. 2 BGB (Civil Code) in connection with § 1 Para. 1, 2 and 4 BGB-InfoV (Civil Code Information Ordinance) as well as our obligations according to § 312e Para. 1 Sentence 1 BGB (Civil Code) in connection with § 3 BGB-InfoV (Civil Code Information Ordinance). Consequences of a rescission
In the case of an effective revocation, the performances received by both parties and if required the uses taken advantage of (e.g. interest), must be returned. Should the received service not be returned entirely or in parts or only in a worsened state you are required to pay damages to us insofar as required. This does not apply to the handing over of objects if the deterioration of the object only results from its inspection – the way in which you may have been able to detect the deterioration in a shop. For the rest, you may avoid the obligation to compensation for the deterioration caused by the purposeful use of the object, by not using the object as if it was your property and by avoiding everything that decreases its worth. Goods that may be returned as parcel shipments are returned at our risk. You must bear the costs of the return, if the delivered goods correspond to the ordered goods and if the price of the goods to be returned does not exceed 40 EUR or if in the case of a higher price you have not fulfilled the return service or the contractually agreed partial payments at the point of the rescission. In other cases the return is free of charges for you. Objects, which may not be sent in packages, will be collected from your house. You must fulfil your obligations to reimbursement of payments within 30 days. For you this term commences with the sending of the declaration of rescission or the goods; for us the term commences with the receipt of the same.
There is no right of rescission for:
- for goods, which are custom-made to the customers specifications or which are clearly tailored to the personal requirements or which are not suitable to returns due to their quality or which may spoil quickly or where the “best before” date would be exceeded.
- for commercial customer

General notes regarding returns
Please, avoid signs of usage and damages to the goods. If possible, please return the goods with all accessories and the original packaging. At any rate, please, use suitable packaging to protect against damages in transit.
Please, do not return the goods freight forward but as insured parcel. If we have to bear the postage costs, we will happily pay the same in advance.
Please, note that the above-stated notes do not represent any conditions for the assertion of your right of rescission.
8. Payment
Payments are against cash in advance to the account stated, by direct debit/automatic direct debit, by down payments, on account for regular customers, by PayPal or by cash on delivery (plus 7.14 € fee for cash on delivery payments). The sensitive bank details are transferred securely via SSL encoding.
9. Retention of title
The goods delivered remain my property to the payment for all claims.
10. Guarantee
The guarantee is according to the legal provisions, whereby in the event of a defect of the good we either provide a supplementary delivery or amendment according to your choice. If the supplementary performance fails or the supplementary goods are also defective, you may return the good in return for repayment of the entire purchase price or you may keep the good and reduce the purchase price.
11. Transport damages
Despite all diligence damages in transit may occur during the delivery process. In this event we will of course replace the damaged items free of charge. In the event of transport damages we would kindly ask you to follow the procedure below:
If possible, transport damages must be reported to the deliverer (parcel service) immediately upon receipt of the goods. Please, notify us subsequently of any transport damages determined. If you wish to return the goods, please, inform us in advance by email, fax or telephone. We will happily help you if you have any queries regarding returns. Your warranty claims remain unaffected from the note regarding the procedure. We would like to thank you for your understanding and your cooperation.

12. Privacy Policy
We use your inventory data to process your order only. We store and process all customer details with respect to the relevant provisions of the Bundesdatenschutzgesetze (BDSG, Federal Data Protection Acts) and the Telemediengesetz (TMG, Telemedia Act).
Your details are secured from the shopping basket in our shop with the help of SSL 128. If you subscribe to the newsletter we save your email address for advertising and market research purposes until you unsubscribe from our newsletter.

Without your express consent, which shall be revocable at any time, we do not hand over to third parties your personal details including your home address and email address. Our service partners, who require the transfer of details for the order processing (e.g. the delivery company commissioned with the delivery and the credit institute commissioned with the payment process), are excluded thereof. In such events the extent of the data transferred is limited to the necessary minimum only.
This note is issued according to the provisions of § 33 Para. 1 Bundesdatenschutzgesetz (BDSG, Federal Data Protection Act). Your issues worthy of protection are considered according to the legal provisions.
Cookies
The Internet sites use so-called cookies on several pages. They help to make our offer more user-friendly, more effective and safer. Cookies are little text files, which your are filed on your computer and which your browser stores. Most of the cookies we use are so-called “session cookies”. They are deleted automatically when you end your visit to the site. Cookies do not damage your computer and do not contain any viruses. We do not collate any personal details via cookies.
13. Miscellaneous
As our goods are natural products, which were treated with the highest level of diligence and precision, it still is possible that size tolerances occur due to natural loss and welling. These are not a reason for complaints. The same applies for the possible natural discolouration (red-tinge etc.) of the beech wood.
2. The castor rollers of the beech containers are for self-assembly. All assembly parts are included and the holes are pre-drilled, the castor rollers only need to be screwed together tightly.
3. Please note: The 30 mm balls may be swallowed. Please, supervise your children!
14. Place of jurisdiction
All disputes from this legal relationship are subject to the Law of the Federal Republic of Germany. The application of the EU or CISG (European Union or United Nations Convention on Contracts for the International Sale of Goods) is excluded. If the contractual parties are business people, the court, where www.tischlerschuppen.de has its office, is responsible, unless an exclusive place of jurisdiction is justified for the dispute.
